The Department of Labor recently issued a notice that the federal minimum wage for non-exempt federal concession contracts will be $10.20 per hour, beginning January 1, 2017. The minimum wage for tipped employees will be $6.80 per hour.
The minimum wage requirement was established under Executive Order 13658 and applies to contracts and contract-like authorizations that grant rights to provide services on public lands. While there are some exemptions to these requirements, determining if any of these exemptions applies to a particular concession operation requires a specific analysis of that operation.
